Scope of definition

The present general terms and conditions of sale (known as "GTC") are concluded between the company SPEAKING IMAGE, whose trade name is PAWNEES: FINGER IN THE NOSE (known as "FINGER IN THE NOSE" or "we", and any natural person, who does not operate for professional purposes or related to a business activity, called "customer" or "you", who wishes to make a purchase on the website www.fingerinthenose.com ("website" or "our website").
If the person wishing to place an order does not fit within the above definition of "customer" (or "you"), he or she is advised to refrain from entering into commercial transactions on www.fingerinthenose.com and to contact marketing@fingerinthenose.com directly.
These Terms and Conditions exclusively govern the business relationship between the customer and FINGER IN THE NOSE. FINGER IN THE NOSE reserves the right to amend these GTC at any time. As soon as they are posted online, they are immediately applicable. Items

The items governed by these GTC are those offered for sale on the www.fingerinthenose.com website and shipped by FINGER IN THE NOSE.
These items are offered for sale within the limits of available stocks and their essential characteristics are described as accurately as possible.

Prices

The prices of the items are indicated in Euros (€) all taxes included (TTC) when the recipient is domiciled within the European Union. They include Value Added Tax (VAT) and take into account any possible ongoing reductions when the order is placed.
The prices of the items do not include delivery costs, which are specified on the page relating to the selected delivery method (cf paragraph "Shipping costs").
No modification of price is possible after order confirmation. Nevertheless, in the event of an error regarding the price, derisory compared to the real value of the item, in a very exceptional manner, FINGER IN THE NOSE reserves the right to cancel the placed order.

Order

After selecting the items and validating the basket by clicking on "Check out", you are invited to complete the contact form for delivery. If you have a PayPal or Apple Pay account and you wish to use one of these payment methods, you will be able to connect to your account on this page. Your delivery information is automatically entered and a choice of delivery method is then requested. Personal information  collected is essential to validate the order: e-mail address, first name, surname, postal address, country, telephone number (landline or mobile). For questions relating to the protection of personal data, we invite you to consult our Privacy Policy. FINGER IN THE NOSE does not require you to create a customer account on www.fingerinthenose.com. You can fill it in the contact form or use the PayPal platform directly accessible on this stage. By clicking on "Log In", you can access your customer account by entering your login and password.
If you wish to create an account, simply click on the dedicated icon at the top of the home page.
To validate the contact form, click on "Continue to shipping method".
Once you have selected then validated the shipping method, you have access to the payment page (cf paragraph "Payment methods"). You can enter an invoicing address different from the delivery address. Otherwise, the personal information entered on delivery is considered as the invoicing address.
By clicking on "Complete order", you validate the order. This applies to acceptance of the prices and descriptions of the items offered for sale on the www.fingerinthenose.com website. FINGER IN THE NOSE will acknowledge receipt by sending an e-mail confirming your order.
After order confirmation, certain special cases such as non-payment or a non-existent delivery address can lead FINGER IN THE NOSE to cancel the order (cf “Cancellation of the order by the seller“) or to block the delivery (cf “Fraud prevention“).
Some of your ordered items may turn our to be unavailable (examples of causes: defective products, stock error...). If they are unavailable in all of our stocks, we will contact you by e-mail to offer a refund or an exchange. The rest of your order will be firm and final.

Payment

Payment methods:

During the last stage of order validation, the following methods of payment are offered:

  • Credit card: Visa, Mastercard, American Express, Apple Pay. Payments are taken immediately.
  • PayPal account: you are invited to connect to your PayPal account. This method of payment is also offered to you when you enter the contact form.
  • FINGER IN THE NOSE gift card.

Fraud prevention:

FINGER IN THE NOSE is very attentive to the risks of identity theft and/or means of payment and as such, participates in the fight against fraud. Thus, we may after payment and sending the order confirmation notification, proceed to a check to verify whether you are the legitimate holder of the credit card or holder of the PayPal/Apple Pay account used for the payment of the order placed on our website www.fingerinthenose.com.
This check is systematic and may lead to a request for documentary evidence of the identity of the person declared in the order and for his/her postal, invoicing and/or delivery address 
Failure or refusal to respond to this control may lead us to not validate the order and to therefore cancel it. 
This control is carried out before the delivery of the order placed on our website and may lead to a postponed dispatch and delivery of the order.

Delivery

Shipping methods:

In order to best satisfy its customers, FINGER IN THE NOSE offers various delivery methods depending on the recipient's country. 

Home delivery against signature by COLISSIMO:

In all the countries our website delivers. COLISSIMO delivers in France and its local partners deliver in other countries (DPD, Bpost, Correos, Parcel Force...).

Pick-up point delivery against signature by COLISSIMO:

In France only.

Express Home delivery against signature by DHL EXPRESS:

In all the countries our website delivers, except Russia.

CLICK & COLLECT delivery:

Only available in Paris (75).

  • Click & Collect Trudaine - Delivery in the FINGER IN THE NOSE store located at 45 AVENUE TRUDAINE 75009 PARIS (Tuesday to Saturday, 11am to 7pm).

As our stores are not open all year round, this delivery method is not always available.

Shipping costs:

Our shipping costs do not include taxes and customs duties applied by countries outside the European Union.
If you live in one of these countries, we invite you to inquire before placing your order to know what additional costs will be charged to you before your delivery.

Free shipping worldwide for all orders of 200,00€ and over. 

Shipping costs include packaging and the selected carrier costs. When possible and according to the country for delivery, FINGER IN THE NOSE offers customers the choice of delivery method and carrier.

Shipping times:

Home and Pick-up point delivery:

After order confirmation and payment, the order will be shipped within the next 24 to 48 working hours (excluding weekends and public holidays). All orders placed before midnight (except during sales and special operations) are prepared and shipped on D+1 or D+2 (except weekends and public holidays).

CLICK & COLLECT delivery:

After order confirmation and payment, the order will be shipped to the selected store within the next 24 to 72 working hours (excluding weekends and public holidays).

Delivery times:

CLICK & COLLECT delivery:

Once your order is delivered, the selected store will send you an e-mail informing you that your order is available. You then have fourteen (14) working days to collect it. If you have not picked up the order within this period, you will receive a reminder via e-mail inviting you to pick up your order within the next seven (7) working days. Once this second period is over, the order will be sent back to our warehouse for order cancellation and refund.

If you find yourself in an exceptional situation preventing you from picking up your order within the maximum deadline but wish to maintain the order, please send us an e-mail at: e-shop@fingerinthenose.com.

To collect an order in our stores, the physical person picking-up the order (whose identity is mentioned on the order form) must present a valid identity document. The customer may also be asked to present the credit card used to pay for the order. If these conditions are not met, the order will not be delivered.

Home and Pick-up point delivery:

As soon as your order is ready to be shipped, you will receive an e-mail with a tracking number and listing the products contained in the package.

All our packages are shipped from France, so the delivery time depends on the selected carrier and the recipient's address. If the carrier is Colissimo, the delivery time outside of France depends on its local partners (DPD, Force Parcel, Bpost...).

Whatever the selected carrier, for deliveries outside the European Union, the delivery time also depends on local customs controls.

Delivery by COLISSIMO:


In France, Colissimo delivers within 48 hours. In Europe, Colissimo and its partners deliver within 2-3 days, in countries such as Germany or Italy.

Delivery by DHL EXPRESS:


In France and in most European countries, DHL EXPRESS delivers within 24 hours. 

Outside the European Union, DHL EXPRESS delivery time is 4-8 days.

Late delivery:

Our shipping carriers' delivery times cannot be guaranteed in the following cases:

  • During high activity periods, such as sales or promotional periods.
  • If the ordered item is not physically available in the e-shop's stock when the order is placed. In this case, our Customer Service will inform you by e-mail.

Even if all is done to avoid this, a delay in the delivery time may occur, either due to our own doing or due to our transport partners. When this occurs, we always try to find the best possible solution for our customers and we systematically contact them by e-mail.

Failed delivery:

Parcel returned to sender:

We always do our best to ensure that delivery is carried out as planned, however in some cases it may fail and the package is then returned to us.

Return cases:

  • The recipient's address is incomplete.
  • The recipient was not present at the address declared in the order when the shipping carrier came to deliver.
  • The recipient was unable to collect the parcel at the pickup point or post office within the time limit.
  • The recipient refused the parcel.
  • No reason was given.

When the parcel is returned to us, we try to find the best solution for our customers by systematically contacting them by e-mail. We return the package only if the recipient agrees. Without this agreement and after a period of five (5) working days, we will proceed to cancel and refund the order. 
Important information: the delivery time for a returned package is longer than for a delivery. Indeed, the shipping carriers do not consider this type of package as a priority.

Lost parcel:

A parcel can get lost. Whatever the reason, the customer is invited to contact us by e-mail at: e-shop@fingerinthenose.com. We will contact our warehouse and the shipping carrier in charge of the delivery to check on the package preparation and dispatch. If this fails, an investigation will be opened with the shipping carrier. The investigation time limit is 90 days. At the end of this period, the parcel will be declared either found or lost. For our part, we are committed to finding the best solution for our customer. We will first try to replace the lost item(s). If the items are unavailable, we will contact the customer for an exchange or refund.

Returns

Time limit for returns:

The customer has a right of withdrawal of fourteen (14) working days as of the date of receipt or withdrawal of the entire order (legal deadline in force).
During this period of fourteen (14) days, no reason for return will be requested other than for information purposes as part of our quality approach, and no penalty will be charged.
Beyond this period and without exceeding thirty (30) working days as of the date of receipt or withdrawal of the order, we ask you to inform us of your intention to return the item and the reason for this return (via the return form below).
After thirty (30) days, returns are refused. In the event that you wish to return one or more items ordered beyond the thirty (30) working day period mentioned above, the package will be systematically returned to you.

By following this link, you will be asked for your postal code and order number. Don't forget to put a # before it.

Please send an e-mail to e-shop@fingerinthenose.com if you have any problems or if you are in one of the following situations:
  • The delivery method of your order was Click & Collect.
  • You live outside the European Union.
  • You wish to change the size or color of an item.
We will then send you a prepaid label if your order is still eligible for a return.

Your package containing the item(s) to be returned must be sent within seven (7) working days of your withdrawal, to the address written on the return label:

Returnable items:

All items available and ordered on our website can be returned, provided they are intact, complete (in their original packaging and with their labels), haven't been washed or worn extensively. Any damaged or incomplete item, or with damaged packaging, will not be refunded and returned to you. 

Our withdrawal period is also applicable to our gift cards, as long as they have not been used, even partially. If the returned item comes from the funds of a gift card, you just need to send us by e-mail and within the same fourteen (14) day deadline mentioned above, the complete code of the returned gift card to: e-shop@fingerinthenose.com. As soon as we receive it, our Customer Service will proceed to its recreditation.


Return shipping costs:

Return costs are free for one return per order, except for items ordered during our private sales or commercial destocking operations. If you return one or more items ordered during our private sales or commercial destocking operations, a return cost contribution of six (6) euros will be deducted from your refund.

Refunds:

Upon receipt of your return package and return form duly completed sent to FINGER IN THE NOSE at 45 AVENUE TRUDAINE 75009 PARIS (France), we will proceed to refund the price of each returned item, subject to compliance with the GTC. The paid shipping costs will also refunded only if the entire order is returned. If you return part of your order, the paid shipping costs will not be refunded.

No return shipping costs contribution will be deducted from your refund, except  for items ordered during our private sales. Indeed, if you return items that are part of our private sales or commercial destocking operations, six (6) euros will be deducted from your refund as contribution to the return costs.
FINGER IN THE NOSE will proceed to your refund within fourteen (14) working days from receipt of your return package or withdrawal e-mail if the returned item is a gift card.
This refund period cannot be guaranteed during certain busy periods, such as sales or promotional periods.
Refunds are always made via the same payment method used for the order.

In case of refund impossibility or failure via the payment method used at the time of the order, the refund will be made via bank transfer. In this case, FINGER IN THE NOSE will ask you for your bank details and will proceed with the bank transfer within fourteen (14) working days following the receipt of the bank details. Refunds are also possible by money transfer via PayPal.

Exchanges

Under the same conditions as returns, exchanges are possible under the following conditions:

    • Only size and/or color exchanges are accepted.
    • It is imperative that the price of the item(s) chosen in exchange be less than or equal to the already paid price - in Euros (€) all taxes included - of the returned item(s).
    • The item(s) chosen in exchange must be available.
    • Only one exchange session per order is possible.

Your exchange request must be sent to our Customer Service by e-mail at: e-shop@fingerinthenose.com. Only then will we be able to reserve the chosen item(s).

If one or more items you wish in exchange are no longer available on our website,  please send us an e-mail. If we find the selected item(s) in another stock, there can be a longer delivery time. In this case, we will inform you and ask you to confirm your exchange request. If you refuse, your request for exchange is then considered as a request for refund within the framework of your right of withdrawal.

Guarantees

In line with the French law, all items sold on our website www.fingerinthenose.com, benefit from the legal guarantee of conformity (article L211-1 and following of the Consumer Code) and the guarantee against hidden defects (article 1641 and following of the Civil Code). These guarantees allow the customer to return a damaged and/or defective item to us.

Some items sold on www.fingerinthenose.com benefit from a specific commercial guarantee. This is the case for Eastpak products. For any claim concerning an Eastpak product, please contact us on e-shop@fingerinthenose.com and we will tell you how you can benefit from this guarantee.

Proof

In line with article 1316-1 of the French Civil Code, once you have entered your credit card number online and validated the order (by clicking on "Complete order"), this proves the validity of your entire order. The sum resulting from the items listed on the order form are payable.
By clicking on "Complete order", the customer expressly signs and accepts all the operations carried out on www.fingerinthenose.com. On the other hand, in the event of fraudulent use of his means of payment, the customer is invited to contact our Customer Service as soon as possible: e-shop@fingerinthenose.com.
The computerized registers that we and our partners keep in our computerized systems under reasonable security conditions are considered as proof of communication, orders and payments made between the client and the company SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE; as well as between the parties in any dispute.
In accordance with the French Commercial Code, our archiving of purchase orders, invoices and delivery notes is carried out on a sufficiently reliable medium and can thus correspond to a faithful and durable copy of the order.

Responsibilities

The obligation of SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE is an obligation of result, and this for the stages leading to the conclusion of the contract, as well as those of its realization. This is why we undertake to describe as accurately as possible all the items sold on our website.
In the event of a failure to perform its obligations attributable either to the unforeseeable and insurmountable fact of a third party, or to a case of force majeure as defined by French jurisprudence, the liability of SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE will not be engaged.
Nor can this liability be engaged for any inconvenience or damage resulting from the use of the Internet network, and in particular a break in service, an external intrusion or the presence of a computer virus.

Intellectual property

The structure and content of the www.fingerinthenose.com website is governed by French trademark, copyright and patent law.
The company SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE is the exclusive owner of the intellectual property rights relating to the structure and content of the www.fingerinthenose.com website, throughout the world.
The entire content of the www.fingerinthenose.com website, including but not limited to texts, graphics, iconographic and photographic representations, are the exclusive property of SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE.

By exception, the logos and photographs of the products of our partner brands are the property of the latter or their authors.
All reproduction rights are reserved, whatever the content of the www.fingerinthenose.com website.

The company SPEAKING IMAGE / PAWNEES FINGER IN THE NOSE gives you its consent to reproduce all or part of the content of its website www.fingerinthenose.com, solely for storage for the purposes of representation on a single-user screen and reproduction, and if this reproduction is carried out for a strictly personal, private use and is neither collective nor commercial. Thus, any networking, rebroadcasting and/or marketing of all or part of the content of www.fingerinthenose.com, in any form whatsoever, is on principle prohibited, except with the prior and express authorization of the Director of Publication.
